Unless otherwise noted all images and content published by @radhauspdx and on radhauspdx.com or campestralgear.com are © RADHAUS and reproduction for commercial purposes without explicit written permission is prohibited.

// INTELLECTUAL PROPERTY

The concept of Intellectual Property is established in Article I, Section 8 of the United States Constitution through the powers vested in Congress to “promote the Progress of Science and the useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries.”

Except as separately established by Patent or Trademark, or otherwise purchased and recorded in a legal document, all work originating from or created by me as an individual or under any alternate formal or informal business names or aliases is owned completely and outright by me as RADHAUS and protected by Copyright law.

As stated in 17 U.S. Code § 102, “Copyright protection subsists, in accordance with this title, in original works of authorship fixed in any tangible medium of expression, now known or later developed, from which they can be perceived, reproduced, or otherwise communicated, either directly or with the aid of a machine or device.”

All original works created by RADHAUS are protected under 17 U.S. Code § 101 as Literary Works “expressed in words, numbers, or other verbal or numerical symbols or indicia, regardless of the nature of the material objects… in which they are embodied” [ie - merchandise, promotional items, marketing materials, informational resources and documents, websites owned by me or other parties, etc] and/or Pictorial, Graphic, and Sculptural Works that “include two-dimensional and three-dimensional works of fine, graphic, and applied art” [ie - photographs, prints, charts, diagrams, sketches, prototypes, models, technical drawings].

Pursuant to 17 U.S. Code § 302 the Copyright “subsists from its creation and... endures for a term consisting of the life of the author and 70 years after the author’s death” and is irrevocable. The only circumstance in which Copyright ownership can be transferred from the direct control of the author to that of any individual or entity is under the terms of 17 U.S. Code § 204, in “an instrument of conveyance, or a note or memorandum of the transfer” that is “in writing and signed by the owner of the rights conveyed or such owner’s duly authorized agent.”

Unless otherwise documented in a written contract and IRS W-2 forms establishing income, social security, Medicare, and any other required tax withholding, all work is created by RADHAUS as an independent professional entity and is not to be considered a work made for hire under any circumstances not expressly recorded in a contract that is explicitly drawn as a Work Made For Hire and includes payment details.

It is common for RADHAUS original works to be implemented in the course of providing samples, examples, or actual execution of consulting and/or management services for clients. Such use may include implementation in or on property [material objects] owned by clients or third parties, and for which any expressed or implied license is temporary, subject to usage fees, and with the right reserved to be revoked at any time for any reason and without prior notice.


// CONFIDENTIALITY AND NON-DISCLOSURE

During the course of providing or performing all creative services and/or physical work, either as an individual or under any alternate formal or informal business names or aliases, professional conduct and confidentiality is to be expected. To formalize this understanding and extend such privileges beyond the period of service non-disclosure agreements are available upon request.

// NON-COMPETE CONTRACTS

Under no circumstances, either as an individual or under any alternate formal or informal business names or aliases, are any terms implied or stated that could directly or indirectly restrict or prohibit future rights to compete or participate in any field or industry.
